PRESTONE LIFETIME LIMITED GUARANTEE

Prestone® Concentrate Antifreeze/Coolant with Cor-Guard® Inhibitors and Prestone® 50/50 Prediluted Antifreeze/Coolant with Cor-Guard® Inhibitors (“Products”) are guaranteed, for the time you own your Vehicle (defined below) (“Guarantee Period”), as follows:

  1. to provide freeze protection to -34° F (or -36° C); and
  2. to provide protection against material damage to or failure of the cooling system parts and components in your automobile or light duty truck (“Vehicle”) due to rust, corrosion and cavitation.

Under this Lifetime Limited Guarantee, we will refund the purchase price of the Products used and repair or replace cooling system parts or components that fail or suffer material damage directly caused by using our Products during the Guarantee Period, subject to the conditions and limitations set forth herein.

THIS IS YOUR ONLY EXPRESS WARRANTY AND GUARANTEE. THIS LIFETIME LIMITED GUARANTEE GIVES YOU SPECIFIC LEGAL RIGHTS, AND YOU MAY ALSO HAVE OTHER RIGHTS WHICH VARY FROM STATE TO STATE.

Conditions for Guarantee Relief.

  1. You must maintain your Vehicle and cooling system according to the Vehicle manufacturer’s specifications and recommendations, including flushing, filling and topping off the cooling system at recommended intervals.
  2. Products must be used and installed (including an initial coolant system flush and fill) according to the Vehicle manufacturer’s and Prestone’s specifications, recommendations and directions. Use of other coolant products may void this Lifetime Limited Guarantee if we determine that such other products have caused or contributed to the damage or failure.
  3. You must use the Vehicle under normal and expected operating conditions, and only for consumer (not commercial) purposes. Any cooling system parts and components in a Vehicle that is subject to excessive or abnormal use or abuse, or used for commercial purposes, are excluded from this Lifetime Limited Guarantee.
  4. You must maintain and provide records verifying your compliance with the terms of this Lifetime Limited Guarantee, including (a) evidence of continuous ownership of the Vehicle, (b) evidence of routine maintenance of the Vehicle and its cooling system (remember to keep all sales receipts for service to the Vehicle), and (c) evidence of purchase and use of the Products (remember to keep all sales receipts for purchase of Products).
  5. You must retain all failed or damaged cooling system parts and components for our inspection, and provide such parts and components if requested by us for analysis.
  6. You must certify continuous ownership of the Vehicle, the use of other products in your Vehicle’s cooling system, and that no other products have been added to the Product.

All information required in the above conditions shall be submitted to us and, in the case of cooling system parts and components, made available for our inspection. We will consider the information, parts and components and analyze and test same, as necessary, in order to determine if the Products directly caused the claimed damage or failure. We reserve the right to reasonably request additional information from you in order to complete our analysis and make an accurate determination on the cause of the claimed damage or failure.

What is Not Covered?

This Lifetime Limited Guarantee covers your cooling system parts and components (e.g. radiator, pumps, hoses and thermostat) only, to the extent they are directly damaged by defective Products. Other engine parts and components are excluded.

Exclusive Remedy.

Your exclusive remedy under this Limited Lifetime Guarantee or otherwise shall be, at our discretion, a refund of the purchase price of the Products and a monetary payment for the repair or replacement for failed or damaged cooling system parts and components. OUR OBLIGATIONS AND LIABILITY (IN TORT, CONTRACT, BY STATUTE OR OTHERWISE) SHALL NOT EXCEED, IN THE AGGREGATE, THE VALUE OF US$1,000 (INCLUDING PARTS AND LABOR).

How to Make a Claim.

Within 90 days of discovering the failure or damage, you will provide us notice of your claim. For Lifetime Limited Guarantee reimbursement, call 1-888-269-0750, or submit your claim by mail to: Prestone Products Corporation, 69 Eagle Road, Danbury, CT 06810, Attn: Consumer Relations. Please provide sufficient information (telephone number, residence address and/or email address) so that we may contact you regarding reimbursement.

Limitation of Liability.

TO THE FULLEST EXTENT PERMITTED BY LAW, PRESTONE SHALL NOT BE RESPONSIBLE FOR CONSEQUENTIAL, GENERAL, INCIDENTAL, INDIRECT, ECONOMIC, PUNITIVE OR SPECIAL DAMAGES (INCLUDING LOST PROFITS, LOSS OF BUSINESS OPPORTUNITIES OR LOSS OF USE OF YOUR VEHICLE). THIS LIMITATION OF LIABILITY AND OUR EXPRESS LIFETIME LIMITED GUARANTEE APPLY TO ALL EXPRESS OR IMPLIED GUARANTEE AND WARRANTY CLAIMS (INCLUDING ANY CLAIMS IN TORT, BY STATUTE, CONTRACTUAL OR OTHERWISE) YOU MAY HAVE. OUR GUARANTEE AND ALL CLAIMS AND DISPUTES ARE GOVERNED BY THE SUBSTANTIVE LAWS OF THE STATE OF ILLINOIS, EXCLUDING ANY CONFLICTS OF LAW PROVISIONS. ALL CLAIMS AGAINST US SHALL BE EXCLUSIVELY BROUGHT IN THE STATE OR FEDERAL COURT LOCATED IN COOK COUNTY, ILLINOIS.
